MIGRATORY BIRD PROTECTION RULE AMENDED
The Texas Railroad Commission (TRC) has amended statewide Rule
22 (16 TAC 3.22 Protecting Birds) to require operators to net, screen, cover
or otherwise render harmless to birds certain open-top tanks that are 8 feet
in diameter or larger. The effective date of the amendment is November 1,
1991.
The original requirement to bird protection called for the covering of
open top fluid containments of 16 feet in diameter or fluid in tanks that are
as small as 8 feet in diameter. The U.S. Fish and Wildlife Service has
prosecuted 47 oil and gas operators for dead birds found in open tanks of
16 feet or less in diameter, therefore, the Commission has determined that
extending the screening and netting requirement to containments of less
diameter will enhance bird protection and will help operators from
prosecution under the Federal Migratory Bird Treaty Act and Texas wildlife
protection laws.
